www.bmw55 Terms & Conditions – Player Agreement for the Philippines

01 Definitions

In these Terms & Conditions, the following terms shall have the meanings set out below unless the context otherwise requires:

02 Acceptance of Terms

By accessing, registering on, or using the www.bmw55 Platform in any capacity, you confirm that you have read, understood, and agree to be legally bound by these Terms & Conditions in their entirety, together with the www.bmw55 Privacy Policy and Responsible Gaming Policy, all of which are incorporated herein by reference.

If you do not agree to any part of these Terms & Conditions, you must immediately cease accessing or using the www.bmw55 Platform. Continued use of the Platform after any published amendment to these Terms constitutes acceptance of the amended version.

03 Eligibility

To register and use the www.bmw55 Platform, you must satisfy all of the following eligibility criteria at all times:

• You must be at least 21 years of age, as required by PAGCOR and Philippine law governing online gaming;
• You must be physically located within the Philippines at the time of gameplay;
• You must not be a resident or citizen of any jurisdiction where online gambling is prohibited by local law;
• You must have a valid, verified Philippine mobile number capable of receiving SMS OTPs;
• You must not be a current employee, contractor, or immediate family member of the Operator or its affiliated entities;
• You must not be subject to any self-exclusion order — whether imposed by yourself through www.bmw55 or by PAGCOR through a national exclusion registry;
• You must have the legal capacity to enter into binding contracts under Philippine law.

The Operator reserves the right to request documentary proof of eligibility at any time and to suspend or terminate any Account found to be in breach of these requirements. False declarations regarding eligibility may result in the forfeiture of all funds held in the non-compliant Account.

04 Account Registration and Security

Each player is permitted to hold only one (1) registered Account on www.bmw55. The creation of duplicate, secondary, or associated accounts is strictly prohibited and constitutes grounds for immediate suspension and forfeiture of all associated balances.

When registering your Account, you agree to provide accurate, current, and complete information, including your real name, Philippine mobile number, and date of birth. You are responsible for maintaining the confidentiality of your login credentials. www.bmw55 will never request your password via SMS, email, live chat, or any other channel.

You are solely responsible for all activity conducted through your Account. If you believe your Account has been accessed without your authorization, you must notify [email protected] immediately. www.bmw55 will not be held liable for losses resulting from unauthorized access where the player failed to maintain reasonable account security.

Accounts that remain inactive (no login, deposit, or gameplay) for a period of twelve (12) consecutive months may be classified as dormant. A monthly administrative fee of ₱50 may be deducted from dormant account balances. Players will be notified via SMS before any dormancy fee is applied.

05 Deposits, Withdrawals & Transactions

All financial transactions on www.bmw55 are conducted exclusively in Philippine Peso (PHP). The Operator accepts deposits and processes withdrawals via the following methods: GCash, Maya (formerly PayMaya), QR Ph, GrabPay, BPI, BDO, Metrobank, InstaPay, and 7-Eleven CLiQQ.

Deposits: Minimum deposit amounts and processing times vary by payment method. GCash and Maya deposits are credited to your www.bmw55 Wallet in real time. Bank transfers via InstaPay typically clear within 15 minutes. The Operator reserves the right to reject any deposit that cannot be verified as originating from a payment method registered in the player's own name.

Withdrawals: Withdrawal requests are subject to the completion of KYC verification. Once KYC is approved, standard withdrawals via GCash and Maya are processed within 5 to 30 minutes. Bank transfer withdrawals are processed within the same business day during standard Philippine banking hours (8:00 AM – 5:00 PM, Monday to Friday). Withdrawal requests submitted outside these hours are processed on the next applicable business day.

Withdrawal Conditions: Players must wager their deposit amount at least once before a withdrawal is permitted. Funds credited as part of a bonus or promotion are subject to the wagering requirements specified in the applicable promotion's terms before they become withdrawable. www.bmw55 reserves the right to conduct enhanced due diligence on withdrawal requests exceeding ₱100,000 within a 30-day period.

06 Bonuses, Promotions & Loyalty Program

www.bmw55 offers various bonuses, promotional offers, and loyalty rewards to eligible players from time to time. All such offers are subject to the specific terms published alongside each promotion. In the event of any conflict between these general Terms & Conditions and specific promotion terms, the promotion-specific terms shall prevail in respect of that promotion only.

General bonus conditions applicable to all www.bmw55 promotions unless otherwise stated:

• Bonus funds are subject to a minimum wagering requirement before they or any winnings derived from them become withdrawable;
• Standard wagering requirements for welcome bonuses are 30x the bonus amount unless the applicable promotion states otherwise;
• Wagering requirements must be completed within the validity period specified for each bonus; unused bonus funds expire at the end of the validity period;
• Only one bonus may be active on a player Account at any given time, unless explicitly stated otherwise by the specific promotion;
• Wagering contributions vary by game type — live dealer games and certain table games may contribute at a reduced rate (e.g., 10%) toward bonus wagering requirements; slot games typically contribute at 100%;
• www.bmw55 reserves the right to amend, suspend, or cancel any promotion at any time with reasonable notice to affected players;
• Bonus abuse in any form — including but not limited to the use of multiple accounts to claim the same offer, coordinated low-risk wagering strategies, or exploitation of system errors — will result in the forfeiture of all bonus funds and associated winnings.

The www.bmw55 Loyalty Program operates on a tiered basis (Bronze, Silver, Gold, Diamond). Loyalty points are accumulated through real-money wagering and may not be transferred between accounts or exchanged for cash directly without meeting applicable conversion requirements.

07 Gameplay Rules and Fair Play

All games available on the www.bmw55 Platform are subject to their individual game rules as displayed within each game's interface. By placing a bet, you confirm that you have read and accepted the applicable game rules. In the event of any discrepancy between the game display and the back-end game records, the Operator's server records shall be the definitive reference.

www.bmw55 uses certified Random Number Generator (RNG) software for all computer-dealt games. RNG systems are independently audited for fairness and randomness. Live dealer games use physical cards, dice, and equipment operated by trained professional dealers in regulated studio environments.

In the event of a technical failure, network interruption, or game malfunction during an active round, the Operator will use server-side records to determine the correct game state at the time of the interruption. Where a fair resolution cannot be determined, the Operator reserves the right to void the affected round and return all wagers placed in that round to the players' Wallets.

www.bmw55 reserves the right to void any bet or withhold any winnings where there is reasonable evidence that the outcome was the result of a software error, a data feed malfunction, or any form of technical irregularity not representative of a legitimate game result.

08 Prohibited Conduct

The following conduct is strictly prohibited on the www.bmw55 Platform. Violation of any prohibition listed below constitutes a material breach of these Terms & Conditions and may result in immediate Account suspension, forfeiture of all balances, and reporting to the relevant Philippine authorities:

• Fraud and Misrepresentation: Providing false personal information during registration or KYC, including false date of birth, identity documents, or payment details;
• Money Laundering: Using www.bmw55 to deposit, layer, or withdraw funds derived from unlawful activity. The Operator complies with the Anti-Money Laundering Act (AMLA) of the Philippines and will report suspicious transactions to the Anti-Money Laundering Council (AMLC);
• Multiple Accounts: Registering more than one Account per natural person, including the use of other persons' identities or payment methods to circumvent this restriction;
• Automated Betting: Use of bots, scripts, automated betting software, or any artificial intelligence system to place bets on the Platform without direct manual player participation;
• Collusion: Any coordinated strategy between two or more players designed to gain an unfair advantage, particularly in live dealer poker or casino hold'em variants;
• Exploitation of Errors: Deliberately exploiting software bugs, pricing errors, or game malfunctions to generate winnings that would not have been achievable under normal operating conditions;
• Unauthorized Access: Attempting to gain unauthorized access to the Platform's back-end systems, other players' Accounts, or any restricted administrative area.

09 Responsible Gaming

www.bmw55 is committed to promoting responsible gaming among Filipino players. We acknowledge that while most players enjoy our Platform as entertainment, a minority of users may develop problematic gambling behaviors. The following tools are available to all registered players free of charge:

• Deposit Limits: Set daily, weekly, or monthly maximum deposit amounts. Limits take effect immediately and can only be reduced immediately; increases are subject to a 7-day cooling-off period;
• Loss Limits: Set a maximum net loss amount per day, week, or month. Once the limit is reached, further gameplay is suspended for the remainder of the period;
• Session Time Limits: Receive automatic notifications after a set session duration; optionally require account logout after the limit is reached;
• Reality Checks: Pop-up notifications displayed at configurable intervals reminding you of your current session duration and net balance movement;
• Self-Exclusion: Temporarily or permanently block access to your www.bmw55 Account. Temporary exclusions range from 24 hours to 12 months; permanent exclusion closes the Account indefinitely. Self-exclusion cannot be reversed during the selected exclusion period.

Players who have activated self-exclusion are prohibited from attempting to circumvent the exclusion by creating a new Account. Any Account created in breach of an active self-exclusion order will be immediately closed and any deposited funds returned after satisfactory verification that the funds belong to the excluded player.

10 Intellectual Property

All content on the www.bmw55 Platform — including but not limited to logos, trademarks, game graphics, software, text, images, user interface designs, and audio content — is the property of the Operator or is licensed to the Operator by third-party game providers. All rights are reserved.

Players are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial recreational purposes. This license does not permit you to copy, reproduce, distribute, modify, reverse-engineer, or create derivative works from any Platform content without the prior written consent of the Operator.

Third-party game content (including slot games provided by Pragmatic Play, JILI, PG Soft, NetEnt, and other providers) remains the intellectual property of the respective providers and is subject to their individual licensing arrangements with the Operator.

11 Privacy & Data Protection

The collection, processing, and storage of your personal data in connection with your use of the www.bmw55 Platform is governed by the www.bmw55 Privacy Policy, which is incorporated into these Terms & Conditions by reference. By using the Platform, you consent to the processing of your personal data as described in the Privacy Policy.

www.bmw55 collects and processes personal data — including your name, mobile number, government-issued ID, and transaction history — for the purposes of account management, KYC compliance, fraud prevention, AMLC reporting obligations, and the provision of personalized player experiences.

www.bmw55 does not sell your personal data to third parties for marketing purposes. Data may be shared with licensed game providers, payment processors, and regulatory authorities where required by law or contract.

12 Limitation of Liability

To the maximum extent permitted by Philippine law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the www.bmw55 Platform, including but not limited to loss of profits, loss of data, or loss of gaming opportunity caused by:

• Technical failures, server downtime, or network interruptions beyond the Operator's reasonable control;
• Actions of third-party payment processors, game providers, or telecommunications networks;
• Unauthorized access to your Account resulting from your failure to maintain reasonable credential security;
• Changes in Philippine law or PAGCOR regulations that require the Operator to restrict, modify, or suspend services;
• Force majeure events including natural disasters, power outages, civil unrest, or pandemic-related restrictions.

The Operator's total aggregate liability to any player in connection with any single incident or series of related incidents shall not exceed the net deposits made by that player to www.bmw55 in the thirty (30) days preceding the incident giving rise to the claim.

13 Account Suspension & Termination

The Operator reserves the right to suspend, restrict, or permanently close any player Account at its sole discretion in the following circumstances:

• Breach of any provision of these Terms & Conditions;
• Failure to complete KYC verification within the required timeframe;
• Reasonable suspicion of fraud, money laundering, or other criminal activity;
• Verification that the Account holder does not meet the 21+ age requirement;
• Receipt of a self-exclusion request from the Account holder;
• Instruction from PAGCOR, AMLC, or another Philippine regulatory or law enforcement authority;
• Account inactivity beyond the dormancy threshold set out in Section 4.

Upon Account closure, any Wallet balance confirmed as legitimately earned (i.e., not subject to active investigation or forfeiture proceedings) will be returned to the player via their last verified withdrawal method within 15 business days, subject to completed KYC. Bonus funds and unmet wagering requirements are forfeited upon Account closure.

Players may close their own Account voluntarily at any time by contacting [email protected]. Voluntary closure requests are processed within 5 business days.

14 Amendments to These Terms

www.bmw55 reserves the right to amend, update, or replace these Terms & Conditions at any time. When material changes are made, the Operator will notify registered players via SMS to their registered Philippine mobile number at least seven (7) days before the changes take effect. The effective date of any amended version will be displayed at the top of this page.

Continued use of the www.bmw55 Platform after the effective date of any amendment constitutes your acceptance of the updated Terms & Conditions. If you do not accept the amended Terms, you must cease using the Platform and may request Account closure in accordance with Section 13.

15 Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, including but not limited to the Electronic Commerce Act (Republic Act No. 8792), the Data Privacy Act of 2012 (Republic Act No. 10173), and the Anti-Money Laundering Act (Republic Act No. 9160, as amended).

Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions, or the breach, termination, or validity thereof, shall be resolved as follows:

1. Internal Resolution: The player must first submit a written dispute to [email protected]. The Operator will acknowledge receipt within 2 business days and provide a substantive response within 15 business days;
2. PAGCOR Mediation: If the dispute is not resolved through internal resolution within 30 days, either party may refer the matter to PAGCOR for mediation in accordance with PAGCOR's dispute resolution procedures;
3. Philippine Courts: If mediation does not resolve the dispute, the parties agree to submit to the exclusive jurisdiction of the appropriate courts of the Philippines.
